This policy is drafted in accordance with Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD), and Law 34/2002 (LSSI-CE).

3. Principles

We process your personal data in accordance with the principles of lawfulness, fairness and transparency; purpose limitation; data minimisation; accuracy; storage limitation; integrity and confidentiality; and accountability.

4. Data We Collect and Purposes

We only collect identification and contact data that you provide voluntarily, mainly through the contact form (name, email address, company, and the content of your message). We do not process special categories of personal data.

Purposes of processing:

  • Responding to enquiries submitted through the contact form and managing the resulting commercial relationship.
  • Providing and managing the services requested (EOR, hiring, work permits, relocation).
  • Where you have consented, sending communications about our services.

The legal basis for processing is your consent, given when you voluntarily submit your data, and, where applicable, the performance of a contract or pre-contractual measures taken at your request. You may withdraw your consent at any time; withdrawing consent is as easy as giving it.

Your data will be kept for a maximum of 18 months from the last interaction, or until you request its erasure, unless a longer period is required to comply with legal obligations or to manage an ongoing contractual relationship.

Your data is processed by InstantLegal S.L.P. and is not sold to third parties. It may be shared with service providers acting as data processors (e.g. hosting and email providers) under contracts that comply with Article 28 GDPR.

Contact form submissions are delivered through FormSubmit (formsubmit.co), a technical provider that forwards the content of the form to our email address. This service is located outside the European Economic Area, so its use involves an international transfer of data to the United States, limited to the data you include in the form. Should any other international transfer outside the EEA become necessary, it will be carried out with adequate safeguards and you will be informed in advance.

8. Your Rights

You may exercise the following rights at any time: access, rectification, erasure (“right to be forgotten”), restriction of processing, data portability, objection, and the right not to be subject to automated individual decision-making.

To exercise them, write to info@instantlegal.es indicating the right you wish to exercise, together with a copy of a document proving your identity. If you consider that your rights have not been respected, you may lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).

9. Minors

Persons under 14 years of age may not provide personal data without the consent of their parents or legal guardians.

We apply appropriate technical and organisational measures to protect your data. In the event of a security breach likely to result in a high risk to your rights, we will notify you and the competent authority without undue delay.

The Website may contain links to third-party websites, which have their own privacy policies. We are not responsible for the processing carried out on those sites.
